Loyacono v. QBE Seguros et al.
Ms. Loyacono engaged our firm after her travel insurer refused to process her trip cancellation. Her husband was diagnosed with pancreatic cancer and they both were forced to cancel their European vacation. Our firm investigated the matter and discovered that the insurer was transacting in insurance in the State of Florida without a certificate of authority. Our firm alleged a class of travel insurance purchasers and settled the matter globally winning Ms. Loyacono her trip cost reimbursement, about $20,000.00 in special damages for her trouble, and her attorney's fees.
Aspen Specialty Insurance Company v. Florida Surgical Lakes
Florida Surgical Lakes engaged our firm after its liability insurer denied its defense in an underlying medical malpractice suit. ASIC sued Florida Surgical Lakes for declaration that it owed no obligation under the contract of insurance. We defended Dr. Lackey, defeated ASIC on Motion to Dismiss, noticed Florida Surgical Lakes' intent to sue ASIC in bad faith and coordinated settlement of the underlying action with ASIC indemnity funds.
Hearn v. AvMed
Mr. Hearn engaged this law firm when he discovered that AvMed collected several months of insurance premiums on an autopay arrangement but was providing no health insurance coverage. We sued AvMed under a variety of insurance consumer protection and bad faith violations winning Mr. Hearn the return of his premiums, costs, and his attorney's fees.
Fusion Logistics v. Old Republic Union & Axis Specialty Insurance
Fusion Logistics engaged the firm when it became clear that its commercial automotive liability insurers intended to spend all of its insurance proceeds to resolve only one of two lawsuits brought against it arising from a car crash. We filed suit against both auto insurers alleging bad faith insurance practices and violations of Florida's insurance consumer protection statutes. Following a short period of litigation, we obtained an insurance-funded settlement of the underlying lawsuits.
